1 Who we are and these terms

These terms cover your use of ExpiryDate: the app, and the website at expirydate.app. By creating an account or using ExpiryDate, you agree to them. If you don't agree, please don't use it.

ExpiryDate is run by Plexo Logic Ltd, a company registered in England and Wales (Company No. 16940619), registered office 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom ("we", "us", "our").

2 What ExpiryDate does

You add your food by scanning a supermarket receipt, scanning a barcode or typing it in. We give each item an estimated keep time, remind you before food goes off, and suggest recipes made from what you have. You can share your kitchen with the people you live with.

3 Free and Premium

The free app includes barcode scanning, typing food in, reminders, the daily kitchen check, the recipe library, the shopping list and a kitchen for up to two people. Free accounts get a set number of receipt scans each month, and the app shows how many you have left.

Premium adds unlimited receipt scans (with a fair-use limit of 20 a day for each kitchen), where your money goes, a week of dinners planned for you, streak protection, the household league and room for up to 10 people. One person's Premium covers everyone in their kitchen while they're members of it.

Prices are shown before you buy. We don't offer a free trial at the moment.

4 Paying, renewing and cancelling

• Premium is a subscription, billed monthly or yearly. It renews automatically until you cancel.
• In the Android app you buy through Google Play: Google takes the payment, and you manage or cancel it in Google Play's subscriptions.
• On our website you buy through Stripe, and you can cancel at any time from Settings (Manage subscription).
• When you cancel, Premium carries on until the end of the period you've paid for, then your account goes back to free. Nothing in your kitchen is deleted.
• If a renewal payment fails, Premium carries on for a short grace period while you update your card: 3 days on the website, and on Google Play the grace period Google gives.
• Google Play purchases are refunded under Google Play's refund policy.
• If you bought on our website, you can cancel within 14 days of your first payment and we'll refund it in full, as long as you've scanned no more than 5 receipts with Premium. Just email us. If you've scanned more than 5, you've had real use of Premium, so that payment isn't refunded.
• Deleting your account cancels a website subscription straight away. A Google Play subscription has to be cancelled in Google Play, because we can't cancel it for you.

Your legal rights as a UK consumer aren't affected by anything in these terms.

5 Who can use ExpiryDate

You must be at least 13 to use ExpiryDate. If you're under 18, please ask a parent or guardian before you buy Premium.

6 Your account and your kitchen

• You sign in with Google or Apple, so please keep that account secure.
• Use your own account, not someone else's.
• A kitchen's owner can invite people with a code, remove members and make a new code. Anyone can leave a kitchen, and the food they added stays with it.
• You can delete your account and everything in it from Settings. Our Privacy Policy explains what's deleted and when.

7 Dates, food safety and allergens

Keep times are estimates from our table of UK food types. They're a guide only and don't replace the use by or best before date on the pack, so always check the label. Never eat food after its use by date, even if it looks and smells fine.

Receipts are read automatically by an AI service. It can make mistakes, so check the list before you add it to your kitchen.

Recipes show the allergens in their ingredients as warnings. A recipe without a warning is not a promise that it's safe for an allergy, so always check the packs of the food you use. Some recipes are written by AI and checked before you see them. Cook food thoroughly and use your own judgement.

Barcode details come from Open Food Facts, an open database under the Open Database Licence.

Where we say a family of four bins about £1,000 of food a year, the figure is WRAP's (the Waste and Resources Action Programme), from its research on UK household food waste using 2022 data. Money figures in the app are worked out from the receipts you scan and what you record doing with each item, so they're only as complete as that.

8 XP, streaks and badges

XP, streaks, levels and badges are part of the game in the app. XP has no cash value and can't be transferred, but you can spend it in the app's XP shop. We may change how XP is earned and spent, and we may remove XP gained by misusing the app.

9 Fair use

Please don't:

• use ExpiryDate for anything unlawful;
• scan receipts that are fake or that aren't yours to use;
• try to get around limits, such as the number of receipt scans;
• copy, scrape or reverse engineer the app, or interfere with how it runs.

We may suspend an account that does.

10 Your data and our app

Your receipts and kitchen are yours. You let us use them only to run ExpiryDate for you, as our Privacy Policy explains. We don't sell your data, show ads or use tracking.

The ExpiryDate name, logo, app and recipe library belong to us.

11 Our responsibility to you

We work hard to keep ExpiryDate running, but we can't promise it will always be available or free of mistakes. We may change or stop features. If we ever stop Premium, we'll refund any time you've paid for and not used.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't let us limit. Apart from that, we're not responsible for losses that weren't foreseeable, or for business losses, and our total liability to you is limited to what you've paid us in the 12 months before the claim.

12 Changes to these terms

We may update these terms. If a change matters to you, we'll tell you in the app before it takes effect. If you carry on using ExpiryDate after that, the new terms apply. If you don't agree, you can cancel and delete your account.

13 The law

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
